Owners hire real estate agents to sell their properties. Are you aware that real estate agents who work for companies with listing inventories are required, by Agency Law, to try to sell their own company's listings first, and then can try to sell properties listed by other companies through the Multiple Listing Service?
To avoid a conflict of interest Agency Law allows real estate agents to sell their own company's listings under a provision called Dual Agency, wherein the agent represents both the seller and buyer. Restrictions are placed on real estate agents as to what they can do for each party as well as on what they can say to the parties; negotiations must be conducted in an unbiased manner. This means that Dual Agency real estate agents can only offer limited advice.
Ironically, only when they are selling homes listed with other companies are real estate agents truly working as the agent for the buyer.
